These Terms of Use describe the terms and conditions by which you (“User”) may access any websites, including https://www.deepfission.com, and any subsites or successor sites (collectively, the “Website”) provided by Deep Fission, Inc. (including its successors and assigns, “Deep Fission,” “we,” “our,” or “us”). By accessing and/or using the Website, you agree to be bound by these Terms and acknowledge that you have read and understood our Privacy Notice, available at https://www.deepfission.com/privacy, which is incorporated herein by reference. We reserve the right to modify these Terms as described below.
1. Eligibility
This is a contract between you and Deep Fission. You must agree to these Terms before using the Website. You may use the Website only if you can form a legally binding contract with us and only in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations (“Applicable Law”).
The Website is not intended for children under the age of 13, and we do not knowingly collect personal information from children under 13. By accessing or using the Website, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms. The Website is not available to any Users we previously removed from the Website.
2. Access to the Website; Website Restrictions
Subject to your compliance with these Terms and any documentation we may make available to you, you are hereby granted a non-exclusive, limited, non-transferable, and freely revocable right to access and use the Website solely for your personal use or internal business purposes, as permitted by the features of the Website. We reserve all rights not expressly granted herein in and to the Website. Except to the extent a restriction is prohibited by Applicable Law, you will not do, and will not enable any third party to do, any of the following:
- disassemble, reverse engineer, decode, or decompile any part of the Website or license, resell, or modify any part of the Website;

- use the Website in competition with us, to develop competing products or services, for benchmarking or competitive analysis of the Website, or otherwise to our detriment or disadvantage;
- bypass the measures we may use to prevent or restrict access to the Website;
- use the Website to transmit spam or other unsolicited communications or for commercial solicitation;
- access any content available on or via the Website through any technology or means other than those provided by the Website or expressly authorized by us;
- attempt to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Website;

You understand and acknowledge that we or our licensors own and will continue to own all rights (including intellectual property rights), title, and interest in and to the Website, all materials and content made available on or through the Website, and all software, technology, and intellectual property underlying or included in the Website. Use of any such intellectual property for any purpose not expressly permitted by these Terms is strictly prohibited.

We care about your privacy. To provide and enhance the Website, we may collect, use, and disclose personal information and aggregated or de-identified information as described in our Privacy Notice. By using the Website, you acknowledge that your information may be transferred to and processed in the United States. While we use reasonable safeguards designed to protect your information, we cannot guarantee absolute security, and you acknowledge that you provide information at your own risk.
5. Usage Data
We may collect diagnostic, technical, usage, and related information regarding your use of the Website (“Usage Data”). To the extent permitted by Applicable Law, all Usage Data is owned by us, and we may use such data for lawful purposes including operating, improving, and analyzing the Website, and sharing aggregated or de-identified insights with third parties.
6. Consent to Transactional Communications and Promotional Messages
If you provide a telephone number to us, you consent to receiving transactional calls or text messages from or on behalf of Deep Fission, including messages related to security, authentication, account servicing, or enforcement of these Terms, as permitted by Applicable Law. Message and data rates may apply.
You may also elect to receive promotional or marketing text messages from Deep Fission. By enrolling, you consent to receiving such messages, which may be sent using an automatic telephone dialing system. Consent is not a condition of purchase. Message frequency varies.
You may opt out of promotional messages at any time by replying “STOP,” “QUIT,” “END,” “CANCEL,” or “UNSUBSCRIBE” to the message you receive. You may receive a final confirmation message. For assistance, contact info@deepfission.com.
7. Your Use of Third-Party Services
The Website may contain links to third-party websites or services (“Third-Party Websites”). We do not control and are not responsible for Third-Party Websites. Your use of any Third-Party Website is at your own risk and subject to that third party’s terms. You release us from any liability arising from your access to or use of Third-Party Websites.
8. Release
You release us from all claims arising out of disputes between you and any third party relating to the Website. You waive any Applicable Law that limits the scope of a general release to known claims.
9. Indemnity
You agree to defend, indemnify, and hold harmless Deep Fission and its affiliates from any claims, damages, losses, or expenses arising from your use of the Website, violation of these Terms, violation of Applicable Law, or infringement of third-party rights.
10. No Warranty; Disclaimers
The Website is provided on an “as is” and “as available” basis without warranties of any kind to the maximum extent permitted by Applicable Law. Deep Fission does not warrant that the Website will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by Applicable Law, Deep Fission will not be liable for indirect, incidental, consequential, or punitive damages. Our total liability will not exceed the greater of one hundred U.S. dollars ($100.00) or the amount you paid to us, if any.
12. Dispute Resolution; Arbitration
Any dispute arising out of or relating to these Terms or the Website will be resolved by binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association under its Consumer Arbitration Rules. You and Deep Fission waive the right to a jury trial and to participate in a class action or class arbitration. You may opt out of arbitration within 30 days of first accepting these Terms by emailing info@deepfission.com.
13. Governing Law; Venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. To the extent arbitration does not apply, you agree that any dispute will be brought exclusively in the state or federal courts located in the State of Delaware.
14. Notification Procedures and Changes to these Terms
We may provide notice by posting updates on the Website or by email, at our discretion. Your continued use of the Website after any changes become effective constitutes acceptance of the revised Terms.

16. General Provisions
These Terms constitute the entire agreement between you and Deep Fission regarding the Website. You may not assign these Terms without our prior written consent, but we may assign them without restriction. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. No waiver will be deemed a continuing waiver.
